A man who shot and killed another man during an argument over a parking space will not be arrested or charged, police in the USA state of Florida say.

According to the Pinellas County Sheriff's Office, around 3:28 p.m. Thursday, Britany Jacobs, 24, was sitting in her auto in a handicapped parking space outside a Circle A Food Store while her boyfriend Markeis McGlockton, 28, and their son Markeis McGlockton Jr., 5, went into the store.

McGlockton, who was in the store with his 5-year-old son, exited the store, walked to Drejka and pushed him down to the ground. Drejka then pulls out a gun and shoots McGlockton square in the chest. That's when Drejka, who is white, pulled a gun and shot McGlockton, who is black, in the chest, just a few feet from the vehicle, Jacobs said.

Britany Jacobs says she feels like the man who shot her boyfriend, and the father of her three children, "got away with murder", she uttered.

As the drivers remonstrated, a witness entered the store and informed the clerk that there was a disturbance outside, police said.

"He's getting out like he's a police officer or something, and he's approaching me", Jacobs told the Tampa Bay Times, describing the fatal incident with Drejka. McGlockton turned and stumbled back inside the store and was soon pronounced dead at an area hospital.

Police say they did not arrest Mr Drejka because of the state's "stand your ground" or "shoot first" statute.




Still, the Gualtieri told reporters, the legal question is not about whether Drejka was right in being the self-appointed protector of the handicap spot.

In a news conference addressing the incident, Pinellas County Sheriff Bob Gualtieri spoke about the "Stand Your Ground" law.

"I'm not saying I agree with it, but I don't make that call", Sheriff Gualtieri said.

You may recall the Stand Your Ground law was changed past year.

He said the case would be reviewed by the state attorney who will determine whether Mr Drejka should be charged.

A sign posted outside Drejka's home Friday said "No Comment" in bold letters, according to WFTS. "It's messed up. Markeis is a good man ... he was just protecting us, you know?"

"This is not right and I need justice", Jacobs said while choking back tears.
