Chinese Court Bans iPhone Models in Patent Dispute

In the latest battle between Qualcomm and Apple, a Chinese specialised intellectual property court has decided that iPhone sales should be banned in China.

But Apple stores contacted by AFP in Beijing, Shanghai and Fuzhou said they were still selling those older models - confirming a company statement that all remain available.

"The orders aren't specific to the operating system installed on the phones", said Don Rosenberg, general counsel and executive vice president of Qualcomm, in a statement to Yahoo Finance.

The patents involve technology that lets iPhone users adjust and reformat the size and appearance of photographs, and manage applications using a touchscreen when viewing, navigating and dismissing applications on their phones, according to Qualcomm.

It was reported on Monday that Chinese courts had granted Qualcomm a temporary injunction on the sale of a number of iPhone models. For its part, Qualcomm believes that Apple owes it more than $7 billion in royalties and licensing fees.

Apple said on Monday it had filed a request for reconsideration with the court, the first step in appealing the ban.

Apple has been nobbled by the Chinese with US Company banned from selling older model iPhones. The chipmaker cheered the decision on Monday, alleging Apple has benefited from its intellectual property. It says it will continue to pursue its legal options.

Now the U.S. and China are in a standoff over the arrest of a senior Huawei executive in Canada and because of an ongoing trade fight.

China has been an important market for Apple in recent years since China Mobile agreed to begin distributing the smartphones in 2014, and a number of Apple stores are open in China.

Under the court order, the iPhone 6s, 6s Plus, 7, 7 Plus, iPhone 8, 8 Plus and iPhone X can not be sold and imported into the country. It creates uncertainty over Apple's business in one of its biggest markets at a time when its falling share prices reflect concerns over waning demand for new iPhones.

As of now, the banned models can still be purchased normally from Apple's official website, Jingdong and other channels. Apple stated that iOS 12 doesn't violate the patents, CNBC reports.
