  • Ex-Dallas Cop Who Killed Man in ‘Mistaken Apartment’ Case Indicted for Murder

The former Dallas Police officer who shot and killed an unarmed black man in his own apartment after allegedly mistaking it for her own was charged with murder Friday, according to NBC News.

The indictment came three months after Guyger fatally shot Botham Jean, 26, on September 6, after she returned home from work.

Johnson would not give details of the secret grand jury proceedings, but says physical evidence and witness testimony convinced jurors it was a case of murder and not manslaughter.

"At the moment of the shooting it was a knowing ... offense", Johnson said. Amber Guyger felt she was in her apartment. She said most officers are good, but in this case, "We're talking about bad cops that go out there and do things against the law".

Guyger turned herself in to the Mesquite jail about 1 p.m. Friday to be booked on the new murder charge, Mesquite police Lt. Stephen Biggs said.

"We recognize and understand the national discord regarding the relationship between law enforcement and the communities we serve", Hall said.

"We have developed the framework for policy change, have supported the restructuring of the Citizen Review Board, pushed to exceed the basic requirements of implicit bias training and have relied on input from our employee advisory and community advisory boards".

BREAKING NEWS: Dallas grand jury indicts Amber Guyger for murder in the fatal shooting of Botham Jean

Within days of the manslaughter charge, Johnson pledged to convene a grand jury to more fully examine the shooting. Police deployed pepper balls on demonstrators a week after the shooting.

Guyger lived in Apartment 1378 of the South Side Flats complex close to Dallas Police headquarters, according to Guyger's arrest warrant affidavit, as cited by Dallas Observer.

"I look forward to the next step, which is a conviction of murder of Amber Guyger", said Allison Jean, mother of Botham, who added that she wants "the proper penalty that will cause her to reflect on the pain she has caused". Our family, as my wife said, we are hurting deeply but we take some comfort at this time with the decision that the grand jury reached.

"He didn't deserve it, he was seated in his own apartment". According to the arrest affidavit, Guyger claimed Jean ignored "verbal commands" before she shot him. Jean lived in the apartment directly above Guyger's in Dallas, a city in the US state of Texas.

Guyger said she realized she was in the wrong apartment when she flipped on the light switch. Jean worked for PricewaterhouseCoopers and hailed from Saint Lucia. A struggle began and Guyger fired her Taser at Perez, who then wrested it away from her.

The 30-year-old told investigators at the time she accidentally entered Jean's Dallas apartment thinking it was hers and believed Jean to be an intruder. It took 16 months, Johnson said, for the case against Roy Oliver to go to trial.
