Spacey, an Oscar-winner, denies groping an 18-year-old in a restaurant in Nantucket, Massachusetts in 2016.
Nantucket District Court Judge Thomas Barrett's ruling means the former "House of Cards" star will have to appear in court on January 7.
An attorney for Spacey, Juliane Balliro, had argued that Spacey's presence at his arraignment would only "heighten prejudicial media interest in the case" and increase the risk of contaminating the jury pool.
The complainant's mother, former TV news anchor Heather Unruh, said in a 2017 news conference that Spacey had bought her son "drink after drink after drink" and had "made his move" when the boy was drunk.
Earlier this month, Spacey appeared to break his silence on the allegations, releasing a freaky YouTube video in the guise of his former House Of Cards alter-ego Frank Underwood - who was killed off amid the real-life claims. "I wish to enter a plea of not guilty", Spacey's affidavit said.
It was unclear whether he was addressing the criminal charge.
Besides those allegations, Mr Spacey also remains under investigation in Los Angeles for an incident that allegedly occurred in 2016, while prosecutors declined to file charges in a 1992 allegation because of the statute of limitations.
Spacey's attorneys have not spoken publicly about the case but in a court hearing questioned the evidence. Her family chose to come forward after others went public with allegations of sexual misconduct against Spacey and other celebrities, she said.
The Cavaliers or Warriors could waive McCaw before January 7 and not be responsible for paying the remainder of his contract. Up until now, the Warriors have been strong on their stance that they will match any offer from another team.
